On April 27, 2009, the CPSC and Paramount Fitness  announced a recall of a leg curl machine after receiving reports of the machine amputating and crushing fingers.  The defective product is the Paramount Fitness PL2100 leg curl machine - a machine designed to work the hamstrings. After hearing about the crushing and amputation injuries in the field, Paramount admitted it had a problem with a design flaw – one that would lead to product liability for the company – that allows people to get their hand caught between the cylindrical counter weight and the frame of the fitness machine. 

 So if you have one of these machines at home or use one at the gym, stop!

MINNESOTA AND WISCONSIN PRODUCT LIABILITY ATTORNEY, NATE BJERKE OF CHAMPION LAW, SPEAKS OUT ON ZIMMER DUROM CUP HIP IMPLANTS

I have blogged about Zimmer Durom Cup Hip implants in the past [INSERT A LINK TO THE BLOG HERE].  Briefly, Zimmer instituted a “stop sale” on its Durom Cup hip implants on July 24, 2008.  The Zimmer Durom Cup sale freeze was prompted by a letter sent to Zimmer and surgeons across the country by a leading orthopedic surgeon in Los Angeles, Dr. Larry Dorr.  Dr. Dorr, who had used the Zimmer Durom Cup implant on over a hundred patients, began noticing a high failure rate in the Durom Cup.  In a letter to his colleagues at the American Association of Hip and Knee Surgeons, Dr. Dorr noted the following concerning the Zimmer Durom cup implants:

  • The failure rate was very high in the first two years after the Zimmer Durom cup was implanted;
  • Symptoms were classic for loose implants;
  • The cups would “just pop free”;
  • He did not believe the fixation surface on the cups was good;
  • The cups were not properly seating to the pelvic bone; and
  • He stopped using the cups after the first time he had to replace a Zimmer Durom Cup implant.

Dr. Dorr wrote this letter concerning the Zimmer Durom Cup hip implant on April 22, 2008 and Zimmer finally stopped selling the Durom Cup implant on July 24, 2008.  Zimmer sent a letter to doctors and patients recommending that doctors monitor their Durom Cup patients closely.   

Zimmer seemed to be taking a step in the right direction when by offering to pay for revision surgeries for people who had the bad hips in exchange for a complete release of any additional claims.  (As a product liability attorney, I don’t think this is adequate because it does not account for rehabilitation expenses, lost wages, or compensation for the time lost and pain a patient suffers.)  It seems now that Zimmer has hardened it stance.  In a case Champion Law is handling, Zimmer refused to pay for the revision surgery ahead of time like they reportedly had done in the past.  Why Zimmer is taking this stance is anyone’s guess – it seems odd in light of the clear product problems.

On April 24, 2009, The National Highway Traffic Safety Administration announced the recall of yet another child seat.  This product defect relates to seats manufactured by Team-Tex America.  The defective child seats being recalled are certain Babyride infant child restraint systems, Model 374199, manufactured on December 18, 2008. The belt routing label with the “horizontal reference line” is incorrectly placed on the child restraint system which fails to conform to Federal Motor Vehicle Safety Standard No. 213, “Child Restraints Systems.”

ATTENTION SPECIALIZED BIKE RIDERS: BEWARE OF PRODUCT LIABILITY DEFECTS!

The first Specialized recall relates to breaking handlebars.  This recall involves HL handlebars on the following 2009 Specialized bicycles: Cross Trail Comp, Myka HT Comp, Myka HT Elite, Rockhopper, Rockhopper Comp and Rockhopper Comp 29. The model number of the HL handlebar is ALR-13 NTFOV and is located underneath the right hand grip of the handlebar. One rider had the handlebars break, causing a crash and head trauma.

The second recall relates to the cable stop.  The cable stop on some bikes can loosen.  The recall is for the following bikes: 2004 Roubaix Comp 18, 2004 Roubaix Comp 27, 2004 Roubaix Pro 18, and 2004 Roubaix Pro frameset models.

Only bicycles with a single rivet fastening the cable stop to the frame are subject to recall. The cable stop is attached through bonding materials and a single rivet mounted at the front of the bicycle. The cables pass through eyelets in the cable stop on the down tube. Bicycles with a double rivet fastening the cable stop to the frame are not subject to recall. The model names of the recalled bicycles can be found on the top tube of the bicycles. One rider had the cable stop loosen, lost control and ended up with fractures and surgery.  

If you have one of these bikes, stop riding it!  Call your dealer and get the parts replaced – Specialized will pick up the tab.

Cannondale Bicycle Recall – 2009 Six 5, Six 6, Six Carbon 5 and Six Carbon 6 Bicycles

 

The U.S. Consumer Product Safety Commission, in cooperation with the Cannondale announced a voluntary recall of several defective Cannondale bicycles.  The Cannondale bicycles included in this recall are the 2009 Six 5, Six 6, Six Carbon 5 and Six Carbon 6 Bicycles.  This recall affects about 1,300 bicycles. 

The hazard arises from the fact that the Cannondale bicycles fail to meet the federal safety standard for bicycles. Spoke protector discs, required on bicycles to prevent the bicycle chain from interfering or suddenly stopping the wheel, are missing from these bicycles. Photographs are included below:

The Consumer Product Safety Commission released a timely warning concerning deadly fires and carbon monoxide hazards with winter home heating.  According to the U.S. Fire Administration (USFA), there have been more than 150 residential fires that resulted in more than 200 deaths since Thanksgiving, 2008. These statistics have led the USFA and fire chiefs to declare the holiday season and start of the new year as one of the deadliest in recent memory.

 

As all of us look for ways to save money in these tough economic times, the concern over additional fire deaths and carbon monoxide poisonings from alternative heating sources is heightened.

 

Home heating equipment is among the top causes of fires and CO Poisonings. From 2003 through 2005, there was an annual average of 57,300 fires and 270 fire deaths associated with portable heaters, central heating systems, and fireplaces and chimneys. There were also 68 deaths, on average, from carbon monoxide poisoning each year associated with these products.

 

Many of us are opting to use space heaters to help heat our homes. Take precautions when using space heaters, fireplaces or other heating sources to help stay warm this winter. Specifically, keep space heaters away from bedding, drapes, shaggy rugs or other things that could catch on fire.  Never use gasoline in a kerosene space heater. Even small amounts of gasoline mixed with kerosene can increase the risk of a fire.

 

The product liability and safety attorneys at Champion Law also recommend using a space heater that has been tested to the latest safety standards and certified by a nationally-recognized testing laboratory. These heaters will have the most up-to-date safety features; older space heaters may not meet the newer safety standards. An unvented gas space heater that meets current safety standards will shut off if oxygen levels fall too low.

 

Do not use portable propane space heaters indoors or in any confined space unless they are specifically designed for indoor use. Always follow the manufacturer’s directions for proper use.

On February 27, Ricardo North America announced a recall of 5, 444 Signo child restraint assemblies manufactured from February to September 2008.  The recall addresses a dangerous condition where the middle front adjuster strap on some seats may not be working, which prevents the harness from properly tightening around the child.

Bicycle Recall, R-SYS Front Wheel Rims – MN and WI Safety Lawyers

On February 4, The U.S. Consumer Product Safety Commission, in cooperation with Mavic USA, announced a voluntary recall of bicycles with R-SYS Front Wheel Rims.  The CPSC and Maverick believe there are about 12,000 bicycles affected by this recall. 

This bicycle recall relates to front wheel rims manufactured by Salomon SAS, of France. The spokes on the bicycle’s front wheel rim can break during use, posing a fall and crash hazard to riders.  This recall includes R-SYS and R-SYS Premium front wheel rims. They were sold as original equipment on various bicycle brands and were also sold separately. R-SYS wheel rims are designed for road bikes. “R-SYS” is printed on the front rim of the wheels. The rims are 22mm in diameter, with 16 tubular, unidirectional carbon spokes. 

 The rims were sold at specialty bicycle retailers from May 2007 through December 2008 for between $700 and $750 for the front wheel of the two-wheel set when sold separately from the bicycle.

 The CPSC has instructed consumers to stop using bicycles with the recalled front wheel rims and contact their bicycle retailer for a free replacement front rim.

On February 26, 2009, the U.S. Consumer Product Safety Commission announced a recall of about 8,600 handlebar stems Used on Salsa Bicycles.  This recall involves all CroMoto S.U.L. stems sold as individual aftermarket units and on these models of complete Salsa bicycles: Ala Carte, El Mariachi, Casseroll Triple, Casseroll Single and La Cruz. The aftermarket stems are black and have the word “Salsa” painted on the extension. The complete bike stems are painted to match the bike model color and have the word “Salsa” painted on the extension. The stems look like this:

These Salsa bicycle stems were manufactured in Taiwan and sold by specialty bicycle retailers across the country from November 2007 through December 2008.  The recalled stems range from 75 through 105-degree rise and extension length from 90 to 120mm. Sold by: Specialty bicycle retailers nationwide from November 2007 through December 2008 for between $880 and $1870 for complete bikes. The aftermarket stems were sold at specialty bicycle retailers nationwide and via web sites from March 2008 through December 2008 for between $60 and $65.
